Terms of service

These Terms of Service (“Terms”) govern your access to and use of Pixto (the “Service”, “Pixto”, “we”, “us”). By creating an account or using the Service you agree to these Terms. The legal entity operating the Service is being incorporated; the formal name, registered address and company number will be published on this page as soon as registration is complete.

1. Service description

Pixto is an AI-assisted website builder. You provide a brief (text, images, files, links). The Service plans, writes and generates a production-quality website which you can preview, edit, publish on a Pixto subdomain or connect to your own custom domain.

2. Account registration

You must provide accurate registration information and keep it up to date. You are responsible for safeguarding your password and for any activity carried out under your account. If you suspect unauthorised access, notify us via the contact page immediately.

3. Acceptable use

You agree not to use the Service to create, host, publish or distribute content that:

  • is illegal under the law of your jurisdiction or the jurisdiction in which the Service is hosted;
  • promotes terrorism, violence, child sexual abuse material, or unlawful discrimination;
  • constitutes a phishing site, malware distribution, a cryptocurrency drainer, fake-shop scam, fake exchange or any other fraud vehicle;
  • infringes the intellectual-property rights of a third party;
  • is defamatory, harassing, or breaches the privacy of an identifiable person;
  • offers regulated services (financial services, healthcare, gambling, controlled substances, weapons) without the licences that local law requires.

We reserve the right to suspend or terminate accounts that violate this section. Where required by law, we will report unlawful content to the relevant authorities.

4. Intellectual property

Your content. You retain all rights to the briefs, prompts, files and other inputs you provide to the Service. You also retain ownership of the website outputs the Service generates from your inputs — the HTML, CSS, copy, layout and assets in your project belong to you.

You grant us a worldwide, royalty-free, non-exclusive licence to host, copy, transmit, transform and display your content only to the extent strictly necessary to operate the Service. We do not use your project content to train any model.

Our content. The Service itself — the platform, source code, user interface, design system, brand and trademarks — remains the property of Pixto. These Terms do not grant you any licence to copy, redistribute or create derivative works of the platform.

Third-party assets. Stock imagery fetched through Unsplash is provided under Unsplash's licence; you may use those images in your published Pixto site but should review the licence if you reuse them elsewhere.

5. Payments

The Service is offered on the following paid plans, billed in euros (EUR):

  • Maker — €12 / month. One project, standard publishing.
  • Atelier — €39 / month. Multiple projects, custom domains, priority support.

VAT (or the local sales-tax equivalent) is added at checkout where applicable, in line with the place-of-supply rules for electronically supplied services in the EU.

14-day money-back guarantee. If you cancel a new paid plan within 14 days of your first payment, we will refund the most recent monthly charge in full. This is in addition to any statutory right of withdrawal you may have under EU consumer law.

Cancellation. You may cancel a subscription at any time from your account settings. Your plan stays active through the end of the current billing period; we do not pro-rate refunds beyond the 14-day window.

Price changes. If we change the price of a plan, we will give you at least 30 days' notice by email before the new price applies to your next renewal.

6. Service availability

We aim to keep the Service available 24/7, but we do not offer a contractual uptime SLA at the current tiers. Scheduled maintenance, unscheduled incidents and upstream provider outages may interrupt the Service. We will use commercially reasonable efforts to restore availability promptly.

7. Warranty disclaimer

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind — express, implied, statutory or otherwise — including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. The output of the AI model may contain inaccuracies; you are responsible for reviewing it before relying on it commercially.

Nothing in this section excludes or limits any liability that cannot be excluded or limited under applicable consumer-protection law.

8. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with these Terms (whether in contract, tort, statute or otherwise) is limited to the total fees you actually paid us for the Service in the twelve (12) months immediately preceding the event that gave rise to the claim.

We are not liable for indirect, consequential, incidental, special or punitive damages, including lost profits, lost data or business interruption, even if we have been advised of the possibility of such damages.

Nothing in this section limits liability that cannot lawfully be limited — for example, liability for death or personal injury caused by negligence, fraud, or any rights you have as a consumer under mandatory law.

9. Termination

You may terminate your account at any time from your account settings. We may suspend or terminate your account, with or without notice, if you materially breach these Terms, if your use of the Service exposes us or other users to legal or security risk, or if we are required to do so by law. On termination your right to use the Service ends; we will retain your data only for the periods set out in our privacy policy.

10. Changes to these Terms

We may update these Terms from time to time. For material changes we will give you at least 30 days' notice by email. Continued use of the Service after the change takes effect constitutes acceptance of the new Terms.

11. Governing law and jurisdiction

These terms are governed by the laws of the European Union and the member state in which the operator is registered. The applicable jurisdiction will be confirmed here once registration is complete. Nothing in this section affects any non-derogable consumer-protection rights you have in your country of habitual residence.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remainder of the Terms remain in full force and effect.
